Terms of Service

The rules for using OmniCheck's website health scans, reports, accounts and monitoring features.

1. Agreement to these terms

These Terms of Service form an agreement between you and 2create, the operator of OmniCheck ("OmniCheck", "we", "us" or "our"). They apply whenever you visit OmniCheck, submit a website for scanning, create an account, use site monitoring or access a report.

By using the service, you confirm that you have read and accepted these terms. If you use OmniCheck for an organisation, you confirm that you have authority to accept them on its behalf. If you do not agree, do not use the service.

2. The OmniCheck service

OmniCheck automatically audits websites for accessibility, broken links, page speed and AI-readiness. It may crawl submitted URLs, render pages in a browser, follow links, read public page content and metadata, call third-party measurement services, store scan results and generate downloadable or shareable reports.

Some features are available without an account. Accounts may unlock higher limits, saved preferences, scan history and scheduled monitoring. Feature limits, scan duration and availability may vary by account type, website size, technical constraints and service capacity.

You must be at least 18 years old, or the age of legal majority where you live, to create an account or use the service on behalf of a business.

3. Acceptable use and authority to scan

You are responsible for every URL you submit. You may scan a website only when you own it, have the owner's permission, or are otherwise legally entitled to test its publicly available pages.

You must not use OmniCheck to:

  • scan private, authenticated or restricted systems without clear authorisation;
  • bypass access controls, robots directives, rate limits or other technical restrictions unless the website owner has expressly authorised that testing;
  • probe for exploitation, introduce malware, disrupt a service or create an unreasonable load;
  • collect personal data unlawfully, target special-category or highly sensitive data, or scan content that you are not permitted to disclose to us;
  • infringe intellectual property, privacy or other rights, impersonate another person, or use the service for unlawful, deceptive or abusive activity; or
  • resell, reverse engineer or systematically extract the service, except where applicable law does not allow that restriction.

We may rate-limit, block or stop scans that appear unsafe, unauthorised or harmful. Product safeguards do not replace your obligation to obtain permission.

4. Accounts and communications

Account information must be accurate and kept current. You are responsible for protecting your password and for activity under your account. Tell us promptly if you believe your account or a report link has been accessed without permission.

We may send service communications needed to operate your account, deliver requested reports, confirm security events or provide monitoring alerts. These are not promotional messages.

5. Reports are automated guidance

OmniCheck reports are produced by automated tools and are provided for informational purposes. Results can contain false positives, false negatives, incomplete findings or measurements that change between runs. A score is a technical snapshot, not a certification, warranty or guarantee of compliance.

In particular, an automated accessibility scan does not replace a manual WCAG audit, legal advice or testing with people who use assistive technologies. PageSpeed results depend on test conditions. Broken-link and AI-readiness results can be affected by authentication, firewalls, robots rules, rate limits, dynamic rendering and third-party availability.

You are responsible for reviewing findings, deciding whether a recommendation is appropriate and testing changes before deploying them.

6. Your content and our intellectual property

You keep all rights you have in the URLs, website content and other material you submit. You grant us a limited, worldwide, non-exclusive licence to access, copy, render, analyse, store and display that material only as needed to provide, secure and improve the service and meet our legal obligations.

OmniCheck's software, interface, branding, report design and original content belong to us or our licensors. These terms do not transfer those rights to you. You may use and share reports generated for your authorised scans, but you may not remove ownership notices or present OmniCheck's service as your own without permission.

If you send feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission.

7. Availability, changes and third-party services

We aim to keep OmniCheck reliable, but scans may be delayed, incomplete or unavailable. We may maintain, change, suspend or discontinue features and may set or revise reasonable usage limits.

The service relies on third-party infrastructure and tools, which may include hosting, email delivery, Google PageSpeed Insights, Google Fonts and website-rendering services. Their availability and outputs are outside our full control. Links to third-party sites do not mean we endorse or control them.

Nothing in these terms removes mandatory consumer rights.

8. Disclaimers

To the maximum extent permitted by law, OmniCheck is provided "as is" and "as available". We do not promise that every issue will be found, that every recommendation is correct, that reports will always remain available, or that use of the service will make a website compliant with any law, standard or platform requirement.

We exclude implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted or error-free operation where the law allows. These exclusions do not apply to warranties or rights that cannot legally be excluded.

9. Limitation of liability

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive loss, or for lost profits, revenue, data, goodwill, business opportunities or anticipated savings arising from the service.

Our total liability arising from or connected with the service will not exceed the amount you paid for OmniCheck during the 12 months before the event giving rise to the claim or EUR 100 if you used only free services. Mandatory consumer protections remain unaffected.

If you use OmniCheck for business purposes, you agree to indemnify us against third-party claims caused by your unauthorised or unlawful scans, your submitted content, or your material breach of these terms, to the extent permitted by law.

10. Suspension and termination

You may stop using OmniCheck at any time. You may ask us to close your account by using the contact details below.

We may suspend or terminate access, stop a scan, remove a report or preserve relevant records when reasonably necessary to protect users or systems, investigate misuse, comply with law, respond to a rights claim, collect an overdue payment or enforce these terms. Where appropriate, we will give notice and a reasonable opportunity to resolve the issue.

Provisions that by their nature should survive termination—including ownership, disclaimers, liability and governing law—will continue to apply.

11. Governing law and disputes

These terms are governed by the laws of Bulgaria, without regard to conflict-of-law rules. The courts in Bulgaria will have jurisdiction, except where mandatory consumer law gives you the right to bring a claim in another court or to rely on the protections of your home country.

Before filing a claim, please contact us and give us a reasonable opportunity to resolve the issue informally. This does not limit any statutory deadline or right to seek urgent relief.

12. Changes to these terms

We may update these terms when the service, our practices or the law changes. We will publish the revised version here and change the "Last updated" date. If a change materially affects registered users, we will provide additional notice where reasonably possible. Continued use after the revised terms take effect means you accept them.

If one provision is unenforceable, the remaining provisions continue in effect. A delay in enforcing a provision is not a waiver of it. These terms, together with the Privacy Policy and any purchase-specific terms, are the entire agreement about the service.
